Terms and Conditions for Tourist Clients of Daniel Eilon in Israel
These terms and conditions ("Terms") outline the agreement between the tourist client ("Client") and the tour guide ("Guide") regarding the provision of tour services in Israel. By engaging the services of the Guide, the Client acknowledges and agrees to be bound by these Terms. These Terms are subject to Israeli law.
1. Services Provided:
a. The Guide will provide guiding services. Where the Client is quoted an hourly or daily rate for guiding services this is to cover the participation of the number of participants in the Client's party agreed upon with the Guide before the tour begins. The fee covers only the services of the Guide and excludes all transport and entrance fees (which the Client will have to pay to third parties either directly or via the Guide), and any food or drink or other purchases the Client might choose to make. In addition where specifically agreed upon between the parties and at the Client's expense the Guide will also arrange transportation, dining, food and/or wine-tasting experiences and/or accommodations and other leisure activities in Israel.
b. The Guide will make reasonable efforts to ensure the safety and enjoyment of the Client throughout the tour.
2. Itinerary:
a. The Guide will provide the Client with a general itinerary, which shall be subject to change in accordance with the Guide's experience and discretion and/or due to unforeseen circumstances and/or events beyond the Guide's control.
b. The Client acknowledges that the itinerary is a general plan and will almost certainly be adjusted as necessary to accommodate local conditions and/or with a view to enhancing the tour experience or in order to make it more suitable for the client's preferences and prior experiences and/or other relevant factors.
3. Payments and Cancellations:
a. The Client agrees to pay the agreed-upon tour fee as specified by the Guide.
b. A deposit comprising 50% of the agreed guiding fee (plus 100% of fees to be paid by the Guide to third parties on behalf of the Client) shall be required upon booking, with the remaining balance due before or at the beginning of the first day of the tour. The deposit is not refundable in the event of cancellation by the Client for any reason.
c. In the event of cancellation by the Guide due to unforeseen circumstances the Client shall be entitled to a refund of the guiding fee element of the deposit paid; the Guide shall also use reasonable endeavours to obtain for the client as large a refund as possible in the circumstances of any Client monies paid out by the Guide to third parties.
4. Travel Documents and Insurance:
a. The Client is responsible for obtaining and maintaining valid travel documents, including passports, visas, and any required permits.
b. The Client is advised to obtain comprehensive travel insurance to cover any unforeseen incidents, medical emergencies, or trip cancellations.
5. Health and Safety:
a. The Client is responsible for ensuring they are physically and mentally fit to participate in the tour activities, and for informing the Guide before the fee is agreed of any special needs or limitations that should be taken into account (including without limitation any difficulties hearing, seeing, walking or climbing, and claustrophobia or vertigo or any other phobias).
b. The Client must comply with all health and safety guidelines provided by the Guide, local authorities, and relevant service providers.
c. The Guide reserves the right to refuse any further touring services or to terminate the Client's participation in the tour if their behaviour poses a risk to themselves, other participants, or the Guide. In the event of a termination by the Guide pursuant to the terms of this sub clause, the client shall not be entitled to the refund of any deposit or tour fee paid.
6. Liability:
a. The Guide shall not be liable for any loss, damage, injury, or delay arising from circumstances beyond their control, including but not limited to acts of nature, terrorism, civil unrest, or third-party negligence.
b. The Guide shall not be responsible for any loss or damage to personal belongings of the Client during the tour.
c. The Client acknowledges and assumes all risks associated with travel, including those inherent in outdoor activities, and releases the Guide from any liability for injuries or damages arising from such activities.
7. Intellectual Property:
a. The Client acknowledges that any materials, including but not limited to photographs, videos, or written content, provided by the Guide during the tour are for personal use only and may not be reproduced or distributed without the Guide's consent.
b. If the Guide takes photographs or videos ("Pictures") during the tour in which the Client appears, unless the Client expressly states otherwise prior to the end of the tour the Client consents to the Guide's use of such Pictures including without limitation for inclusion on the Guide's website.
8. Governing Law and Jurisdiction:
a. These Terms shall be governed by and construed in accordance with the laws of the State of Israel.
b. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Israel.
By engaging the services of the Guide, the Client confirms that they have read these Terms and agrees to be bound by them.
